ZONING BOARD OF APPEALS

NORMAND ARSENAULT                                                                                            V 1106
The Zoning Board of Appeals held a public hearing on September 15, 2011 at 7:00 p.m. in the Selectmens Room of the Starbard Building, 1204 Main Street, Holden, MA on the Petition of Normand Arsenault for property lo-cated at 185 Salisbury Street for a Variance for relief from area, front and rear setback requirements for the demolition of the existing house and construction of a new house.

Members in attendance:  
R. Spakauskas, S. Annunziata, R. Oslebo and R. Butler.                     

The Chairman called the meeting to order.  Since there were no objections, the reading of the legal notice and list of abutters was waived.  The Secretary read the application and Findings of Fact.

Mr. John Boyce, the architect for the project, represented Mr. Arsenault and gave the Board an over-view of the case.  The applicant lives across the street from the Town pool parking lot and has owned and occupied the premises for over 35 years.  At one time, this was part of a much larger parcel, which included the Dawson School.  Mr. Arsenault has the original homestead on a ‘postage stamp parcel’ and any time he wished to do some work there, it would not be reasonable for him to come before the Board each time.    

Mr. Boyce further explained that Mr. Arsenault is planning to demolish and rebuild approximately the same size house.  It will be handicapped accessible and energy efficient.

Mr. Spakauskas asked if the existing shed would remain; it was answered no.  He also asked if the foundation was also coming down; Mr. Arsenault said yes.

Dennis Lipka, Building Commissioner, told the Board that they may see more of these applications in the future due to the new building code standards.

The public hearing was closed at 7:25 p.m.

The Board voted 4-0 to approve the variance request with the following conditions:  1) The Board accepted the plans as submitted;  2) The shed will be removed from the property;  3) The existing house and foundation will be demolished;  4) As-built plans must be done by a registered land surveyor.
